Minimum Necessary Standard. Only access and share the minimum amount of PHI needed for the task. An AI chatbot answering "what are your office hours" doesn't need access to any PHI. An AI processing "I need to reschedule my appointment" needs the patient's name and appointment details — nothing more.
Audit trail. You need to log who accessed what data, when, and why. This applies to AI systems too — every interaction should be logged.
What You CAN Automate in Healthcare
Not all patient interactions involve PHI. Many don't. These are safe to automate with any AI tool:
General inquiries (no PHI): - Office hours and location - Insurance plans accepted - Services offered - New patient intake process - Parking and directions
Scheduling-related (minimal PHI): - "I need to schedule an appointment" → link to scheduling portal - "How do I cancel my appointment" → cancellation instructions - "What's your cancellation policy" → policy text
Administrative (no clinical PHI): - Billing questions about payment methods - Patient portal login issues - Document submission instructions - Prescription refill process (directing to the portal, not processing the refill)
These questions make up 50 to 70% of incoming volume for most practices. Automating them doesn't require a BAA because no PHI is being processed — just intent classification and template responses.
What Needs HIPAA-Grade Protection
Any interaction that involves specific patient health data needs full HIPAA compliance:
- "What were my lab results?" — PHI - "I need to change my medication" — PHI - "My insurance claim was denied" — PHI - "I need my medical records" — PHI
For these, the AI should classify the intent (so it arrives at the right department) but NOT display or process the actual health data in the response. Route to a human who's authorized to access the patient's record.

Here's why intent classification works especially well in healthcare: the AI never sees or stores PHI.
The classifier reads "I need to reschedule my Thursday appointment" and outputs: intent = appointment_reschedule, confidence = 91%. That's it. It doesn't pull the patient's record. It doesn't know what Thursday appointment. It just identifies what the person wants.
The routing rule then fires: send the patient a link to the scheduling portal, or route to the front desk with the classification attached. The human handles the PHI part.
